1.1. This Document represents the general terms or conditions of use of the page for the purchase of art products and services by the artist Alexandrina Karadjova - Acrista, through the legal entity she represents, Acrista Art EOOD. This Document shall list the rules for using https: //www.acrista.com, including the conclusion of a contract of sale.
2.1. „Acrista Art” EOOD is a company with registered office and address of management Sofia 1111, Slatina district, residential complex Geo Milev, 34 Edison Street, with UIC 131255982.
2.2. Acrista Art EOOD administers the online store www.acrista.com, hereinafter referred to for brevity as "The Site". Acrista Art EOOD will hereinafter be referred to for brevity as Acrista Art.

3.1. Registration - the process of creating a User Profile for the Customer / User.
3.2. Customer / User - any natural person aged 18 or over, legal entity or other enterprise that meets one or more of the following conditions:
3.2.1. acquires access to the Content through the Site;
3.2.2. makes a purchase or order and enters into a distance sales contract through the Site.
3.3. Profile (of the Client) - an entry in the database of the Site, containing the data of the Client / User, including, but not limited to: names, e-mail address, telephone number, delivery address (s), company(s) invoicing details, purchase history, accrued discount, profile picture or avatar.
3.4. Seller - Acrista Art;
3.5. Website - the e-shop hosted at the web address www.acrista.com;
3.6. Shopping bag - section (sub-page) on the Site, which allows the Customer to add Products that they wish to buy at the time of their addition or at a later stage;
3.7. Sale (Purchase) - an electronic document representing a form of communication between Acrista Art and the Client, through which the Client declares to the Seller, through the Site, their desire to purchase Products and / or Services.
3.8. Order - A special case of Purchase (sale) in which one or more of the products added to the Shopping bag is not physically available at the time of creation of the sale, ie. must be made to Order.
3.9. Product (s) / Good (s) - Acrista Art original paintings, reproductions (prints), calendars, catalogs, vouchers, books and any other products described in any of the sub-sections of the "Portfolio" menu, or any other product located on the Site.
3.10 Service (s) - Professional services provided by Acrista Art, including but not limited to: a made to order painting, art arranging consultancy, art lighting consultancy, and any other services described in any of the sub-sections of the menu "Services", or any other service requested through the Site.
3.10. Available Product - Available products are those Products that have already been produced and can be sent to the customer immediately after confirmation of the Sale (for example: finished original paintings, already produced Available prints, etc.)
3.11. Commissioned (Made to Order) Product - Products that are not Available and which can be Commissioned or Ordered, the production of which will begin after confirmation of the Sale (for example: prints (reproductions) with custom sizes, requested by the Client, Gift Vouchers, Art Furniture or Commissioned Paintings.
3.12. A Print (Reproduction) is a high-quality print of an image on canvas. Acrista Art uses very high quality canvas as a basis for the offered prints. Wide-format printers that print with 10 color heads at a time are used for the printing process. The output files are obtained through high quality studio photography.
3.13. Contract - is a distance contract concluded between the Seller and the Client for the sale of Products and / or Services through the Site, based on, and an integral part of which are, these general terms of use of the Site ("Document").
3.14. Content - all of the information on the Site that is accessible through an Internet connection and the use of a device connected to the Internet; The content of any communication from the Client to Acrista Art, sent by electronic means and / or any other available means of communication; Any information provided, in any way, by an employee / associate of Acrista Art to the Client by electronic or other means for its remote transmission; The information on the Site related to the Goods and Services and / or the applied pricing rates by the Seller in any given period of time; The information on the Site concerning the Clients and related to the Goods and Services, and / or the pricing rates applied by third parties, with which the Seller has established partnership agreements of some form;
3.15. Commercial message - any type of message sent through electronic communication channels (such as e-mail, SMS, etc.), containing general and thematic information, information about products and services, information about offers or promotions, information about the Goods and Services, as well as other commercial communications such as marketing and consumer surveys.
3.16. Transaction - the action a) by the Client to pay for ordered Products and / or Services through the Site to Acrista Art, or b) by Acrista Art to recover the amount paid by the Buyer as a result of cancellation, termination, refusal or non-conclusion of a contract of sale through the Site, carried out in accordance with the manner specified in the Sale, or in another way agreed in writing between the Client and the Seller.
3.17. Specification (s) - all characteristics and / or descriptions of Goods and / or Services as stated in their description.
4.1. The General Terms and Conditions of Acrista Art shall be considered binding for all Clients of the Site.
4.2. Any use of the Site means that you have (a) carefully read the general terms and conditions for its use and (b) have agreed to abide by them unconditionally.
4.3. Acrista Art reserves the right to update and amend the General Terms and Conditions of the Site periodically to reflect any changes in the manner in which the Site operates and the terms or any changes in legal requirements. In the event of such a change, Acrista Art will publish an amended version of the Document on the Site. The General Terms and Conditions in force at the time of concluding the distance contract between the Client and the Seller shall be applied to each transaction through the Site.
4.4. If any of the provisions of these General Terms and Conditions for use of the Site prove to be invalid or inapplicable, regardless of the reason, this does not lead to the invalidity or inapplicability of the other provisions.
4.5. Acrista Art strives and makes significant efforts to maintain the accuracy of the information presented on the Site. However, taking into account the technical features and differences in technologies for digital transmission and printing of images, Acrista Art clarifies that the images of the products are for illustrative and guiding purposes only and, respectively, the delivered products may differ from the images.
4.6. All goods, including those in promotion / discount, are sold and delivered until the quantities are exhausted, even if this is not explicitly stated on the Site.
4.7. The site may contain links to other sites. Acrista Art is not responsible for the privacy policies of websites that it does not administer, or for any other information contained therein.
5.1. The Client declares their desire to make a Purchase or to Order and buy Product (s) and / or Service (s) through the Site by making a Purchase electronically or by telephone which is registered by the Client or by an employee of Acrista Art on the Client's behalf.
5.2. Acrista Art will send a notification to the Client for registration of the Purchase in their system, which does not mean it has been accepted, confirmed or that a commitment for its fulfillment has been made. This notification is made by Acrista Art electronically (email) or by telephone.
5.3. Acrista Art has the right not to deliver part or all of the Products in the Purchase for various objective reasons, including but not limited to depletion of their stock. In all cases, Acrista Art shall notify the Client of this fact by e-mail or telephone. In this situation, the only responsibility of Acrista Art is to return any payment that has been received in advance for the Product or Service.
5.4. The distance sale contract between Acrista Art and the Client is considered concluded at the time of receipt by the Client of a notification in their e-mail inbox and / or an SMS sent to their telephone, informing them that the Product comprising the Order is ready for shipment. Such a message contains a notification that the client will be additionally notified by a courier about the delivery details if this option is selected.
5.5. The Contract of sale concluded between the Client and Acrista Art consists of these General terms and conditions and any additional agreements between Acrista Art and the Client.
6.1. Access to the Site for the purpose of making Purchases / placing Orders is allowed to any registered Client. Making electronic sales to unregistered users / Clients through the site is not allowed.
6.2. Acrista Art reserves the right, in its sole discretion, to restrict Client's access to making a Purchase or Order, and / or to any of the possible payment methods if the Client abuses their rights in any way and this is to the detriment of Acrista Art or a third party. In this situation, the Client has the right to contact Acrista Art to be informed about the reasons that led to the application of the above measures. In these cases, Acrista Art is not responsible for any damages that the Client has suffered or may suffer as a result of this action.
6.3. All prices of Goods on the Site are final, announced in Bulgarian Leva (BGN). The site allows the conversion of prices in euros (EUR) for reference purposes (mainly for buyers outside Bulgaria).
6.4. In the case of online or bank payments, the Seller shall not be liable for any charges in connection with any fees, commissions or other additional payments made by the Client or his bank in connection with the Transaction itself, as well as in the cases of currency exchange applied by the bank that issued the card to the client in the cases where the currency is different from BGN.
7.1. Unless otherwise stated, the Content as defined in the Definitions chapter, including but not limited to logos, any graphic images or inscriptions, symbols, texts and / or multimedia content of the Site, is the exclusive property of Acrista Art.
7.2. Nothing in the remote contract concluded between Acrista Art and the Client will be considered as permission from Acrista Art to copy and distribute Acrista Art Products and / or Content, except with the express consent of Acrista Art.
7.3. The Client has the right to use the Content for commercial purposes if and only if they have received the written consent of Acrista Art, applicable solely to the part of the Content, in the manner and extent of its use and within the time limits for which such consent has been explicitly given. Any subsequent or different use of the Content will be considered a breach of this agreement between Acrista Art and the Client and a breach of the intellectual property rights of Acrista Art, who has the right to hold the Client responsible.
7.8. Acrista Art allows the use of copyrighted images of its works of art for non-commercial purposes only, and only subject to the following conditions:
a) Mandatory indication of the author. Тhe name of the artist behind Acrista Art - Alexandrina Karadjova, her pseudonym - Acrista (Акриста in Cyrillic characters), or the legal entity Acrista Art (Акриста Арт in Cyrillic characters) can be used for this purpose.
b) A link to the Site (acrista.com) is recommended.
c) It is strictly forbidden to modify the images in any way, including but not limited to: cropping, cutting/framing, retouching, removing watermarks, etc.
8.1. The Client may make Purchases or Orders through the Site by adding the desired Products and / or Services to his Shopping Bag, following the steps specified on the Site to complete the respective Sale.
8.2. Adding Products and / or Services to the Shopping Bag without the Sale being completed does not result in the registration of the Sale and the automatic retention of the Products or Services.
8.3. The Client undertakes and is responsible for having all data provided to Acrista Art in connection with the implementation of the Sale and / or Order to be true, complete and accurate as of the date of sending. The Client gives permission to Acrista Art to provide this data to the selected courier service provider for the needs of the delivery of the purchased Goods, when this Delivery Method is selected.
8.4. By sending the order, the Client allows Acrista Art to contact them in any possible way, when this is necessary in connection with the purchase / order or the concluded Contract.
8.5. Acrista Art has the right to refuse to fulfill (cancel) the Order made by the Client, for which they should notify the Client. Cancellation of the sale / order does not entail any liability or subsequent obligation of either party to the other party in connection with it and accordingly neither of them has the right to seek compensation from the other for its cancellation in the following cases:
a) non-acceptance by the issuing bank of the Client of the transaction for online payment;
b) fulfillment of the money transaction, which does not result in the receipt of funds on the Seller's account in the case of online payments;
c) the data provided by the Client on the Site are incomplete and / or incorrect.
8.6. The Client exercises their right to withdraw from the distance contract within the statutory period. This period starts from the date of concluding the Contract for the rendition of Services or from the date of receipt of the purchased Goods by the Customer or a third party. In connection with their withdrawal from the contract concluded at a distance, the Client may contact Acrista Art by e-mail at acrista@acrista.com or by phone at +359 88 7986879. The return may be made in person or by courier service. In case of return by courier service, the cost is at the expense of the Client.
8.7. Acrista Art undertakes to refund the paid price of the Contract concluded at a distance from which the Buyer has withdrawn within 14 (fourteen) days from the date of return of the relevant Goods. The amount will be refunded as follows without incurring any additional costs for the Buyer using the same means of payment used by the Buyer in the initial transaction, unless the Buyer has expressly agreed to use another means of payment.
8.8. All Clients have the right to withdraw from the concluded distance contract and return the goods, provided that the integrity of the purchased Goods and their commercial packaging are not damaged.
Acrista Art offers a service for creating paintings specifically for an individual case or for specific spaces, according to parameters set by the Client. The paintings created in this way are commissioned (Made to Order) Products. Unless otherwise agreed by the Parties, the creation of these commissioned works of art shall comply with the general clauses set out in this Chapter.
9.1. Commissioned paintings cannot be copies of paintings already sold. They may be based on an existing picture as a plot / theme / subject, but in all cases they are works of art with their own radiance.
9.2. The specific subject, dimensions, color range, feel, delivery deadline, project start date and other details for the Commissioned Paintings are negotiated in advance with the Client.
9.3. The minimum delivery deadline for a Commissioned Painting is 30 (thirty) working days from the date indicated in advance by Acrista Art to be the date on which work on it will begin.
9.4. Acrista Art sends an offer for creating a Commissioned Painting, which includes the value of the painting, including external / final framing, start date and deadline.
9.5. After the approval of the offer by the Client, Acrista Art creates a small format conceptual design for visualization, which is sent to the Client for approval.
9.6. After approval of the conceptual design by the Client, the Client pays in advance 50% (fifty percent) of the agreed price of the service.
9.7. When it is ready, the Commissioned Painting is sent for framing, and the Client receives a notification about this, as well as an invitation to pay the rest of the agreed value of the Service.
9.8. The client has the right to refuse the creation of the Commissioned Painting at any time before approving the small conceptual design.
9.9. In case of cancellation of the order after the conceptual design has been submitted and approved, Acrista Art has the right to keep the advance amount as compensation for the time, energy and materials invested, as well as potential lost profits up to that date.
10.1. Not all Acrista Art paintings can be purchased or ordered as Prints. The paintings for which this is possible can be found using the appropriate filter in the portfolio of original paintings.
10.2. Available prints are a type of Available Product that can be purchased immediately. They are pre-printed, in some cases framed, with sizes determined by Acrista Art.
10.3. You can Order a print from paintings for which it is possible to create Prints, but there is currently no Available Print or the Available Print is not in the size you need,
10.4. You can order a Print by selecting the "Order Print" option under one of the paintings for which this is allowed.
10.5. Available or Made to Order (custom sized) Prints can only be created from already sold original paintings. If a painting (original) is still available on the site, you can buy it, but not order a print from it.
10.6. The sizes of Made to Order Prints are set by the User during the order process, through the respective size sliders, or the fields for manual size entry.
10.7. The size of the ordered print is limited to correspond to the aspect ratio of the original picture, and the minimum and maximum sizes depend on the source file. The minimum and maximum sizes are given in the information field for each painting from which a print can be ordered.
10.8. If you want to order a print with a non-standard size (framed in a proportion different from the original picture, or in a larger size, for example for photo wallpaper) you must contact Acrista Art for additional agreement.
10.9. All Prints are available in a limited edition (Limit), which determines the maximum total number of copies / reproductions that can be made from a specific painting, regardless of the size of the Print. Information about the order of the Print and the limit for the respective painting are placed on the finished print.
10.10. When the limit is reached, no more prints will be produced from the corresponding painting.
11.1. Acrista Art allows you to reserve a painting by paying an advance.
11.2. You can reserve a painting for a period of no more than 20 (twenty) days.
11.3. Reservation is done by paying a deposit of 20% (twenty percent) of the price of the painting.
11.4. If after the retention period of 20 (twenty) days you do not pay the remaining amount, the painting is declared available and the deposit is retained as compensation for lost profits.
12.1. Acrista Art offers the purchase of vouchers with a value specifically selected by the User / Client.
12.2. Vouchers can be electronic or physical:
a) Electronic vouchers are sent to the e-mail specified by the client, and a specific date for their sending can be optionally selected. The electronic vouchers are in .pdf format (Portable Document Format).
b) Physical vouchers are printed on cardboard and laminated, for which a printing fee is charged in the Client's Purchase / Order. Vouchers are sent in an elegant gift envelope by courier to the address specified when the voucher is added to the Shopping Bag by the User / Client.
12.3. Regardless of the type of voucher, it contains a title image, value, unique code and a text message, all selected by the User / Client at the time of purchase.
12.4. When purchasing a voucher the acumulated client discount is not applied towards the selected by the client value of the voucher.
12.5. The vouchers have unlimited validity and can be used both on the Site and for an offline purchase.
12.6. Cash cannot be received against the vouchers. They can only be used as a cash equivalent when purchasing / ordering Acrista Art products or services.
12.7. When using a voucher in a purchase, in case the recipient of the voucher chooses product (s) with a higher value than the value of the voucher, they have the opportunity to pay the balance with one of the available payment methods.
12.8. When using a voucher in a purchase, in case the recipient of the voucher chooses product (s) with a lower value than the value of the voucher, the voucher will be considered to be used in full and the difference between the value of the voucher and the purchase value is non-refundable.
13.1. The Client agrees that by providing any personal or other data to Acrista Art, they may be used by the latter for the following purposes: maintaining an up-to-date customer database, including registration of Sales / Orders, sending ordered products and execution of Services, invoicing, resolving disputes with Clients regarding their Purchases / Orders or consideration of their requests;
13.2. By providing their data to Acrista Art (including e-mail address), the Client gives their explicit consent to be contacted by Acrista Art or third parties who are couriers or other service providers related to the realization of purchases made by the Client.
13.3. With the exception of the cases described in item 13.1. and 13.2., as well as the cases provided for by the laws of the Republic of Bulgaria for providing information by court order, Acrista Art does not disclose data about its clients to third parties on any occasion.
14.1. By subscribing to Acrista Art Newsletter, the Client gives his consent to receive Commercial Messages.
14.2. The Client may withdraw their consent given to Acrista Art to receive Commercial Messages. They can announce such withdrawal at any time by contacting Acrista Art by e-mail or telephone, or by using the automatic functionality in their Profile.
14.3. Acrista Art may use Client’s data anonymously in shared databases, which are statistically processed for market and consumer research purposes. Client data will not be disclosed to third parties except as expressly provided in Chapter 13.(Confidentiality) in this Document.
You can object to the use of your data for market research purposes at any time by contacting Acrista Art.
14.4. Refusal to receive Commercial Messages does not automatically constitute a waiver of consent to enter into this Contract.
15.1. The prices of Goods announced on the Site are in Bulgarian Leva (BGN) and are final.
15.2. The price and method of payment are indicated for each Sale.
15.3. The client is obliged to provide all the necessary information for the issuance of an invoice in accordance with current Bulgarian legislation.
15.4. Acrista Art issues an invoice to the Client for the purchased and delivered Products and / or performed Services on the basis of the information provided by the Client.
15.5. Acrista Art issues an invoice for each sale made through the Site. The Client agrees to receive such an invoice electronically, said invoice being sent by e-mail to the address specified by the Client in their Profile. If necessary, the Client may contact Acrista Art at the e-mail and / or telephone number listed on the Site and request that an invoice be sent to another e-mail. In case the Client wishes to receive an invoice on paper, such can be sent by courier, and the Client pays for the courier service.
15.6. The Website supports the following mayment methods:
- Cash-on-delivery (through the selected courier services supplier). The method is only availabe for purchases in Bulgaria.
- Bank wire (using the supplied bank requisites of Acrista Art EOOD during the checkout process). The method is available to all Clients, regardless of their geolocation.
- Credit or Debit card or payment account (through e-Pay). Payments using a bank card via the virtual POS terminal of e-Pay is available to all Clients, regardless of their geolocation. Payment using e-Pay microaccount is only available to e-Pay registered users. An important characteristic of the virtual POS terminal used is that you might NOT be able to pay using some bank cards issued in the USA, Canada and Australia.
- Credit or Debit card or payment account (through PayPal). Payments using a bank card via the virtual POS terminal of PayPal is available only to Clients outside Bulgaria. Payment using PayPal's payment account is only accessible for Clients outside Bulgaria who are registered PayPal users.
15.7. In the cases of bank card payments, the Client's payment card data will not be available to Acrista Art, nor will it be stored by Acrista Art, but only by the issuer of the respective payment card or by another entity, which is authorized to provide services for storage of payment card identification data.
15.8. Authorized entities for the provision of card data storage services are the following platforms:
a) ePay.bg operated by EasyPay AD, a company established and operating under Bulgarian law, entered in the Commercial Register with a unique identification number 131344648, with registered office and address of management in Sofia, 16 Ivan Vazov Str., and
b) PayPal.com operated by PayPal (Europe) S.à r.l. et Cie, S.C.A. (“PayPal”), with address 22-24, Boulevard Royal, L-2449 Luxembourg and VAT identification number LU22046007.
15.9. Acrista Art allows for Orders/Sales valued 500 BGN or more to be payed in installments.
15.10. Prolonged payment (in installments) is allow for up to 6 (six) consecutive months, including the month the Sale/Order was made.
15.11. Cumulative Client discont is not applied to Sales/Orders payed in installments.
15.12. Users/Clents who choose to pay for their purchases in installments will receive monthy reminder for the owed installment, which will be sent to the e-mail address given in their user profile. Clients may choose to pay more than one installment at any time.
15.13. In case an Order/Purchase in installments is not fully fayed for by the end of sixth (final) month, Acrista Art EOOD has the right to charge a penalty of 1% of the total value of the Purchase/Order for every month delay, but no more than a total of 10% of the Purchase/Order value.
16.1. The Seller undertakes to deliver the ordered and purchased Goods themselves or through a courier company to an address specified by the Client, or to the office of the courier company, depending on the choice of the Client.
16.2. Acrista Art will ensure the appropriate packaging of the Goods and the sending of supporting documents, if any.
16.3. Acrista Art, through its courier service provider, will deliver the Goods to any country in the service area of the selected courier service provider.
16.4. For deliveries outside the European Union, Russia, USA, Canada and Australia, additional negotiation of the terms of delivery may be required between Acrista Art and the Client, depending on the destination and the delivery options available at the time of the order / purchase. Acrista Art reserves the right to refuse to fulfill such orders if it considers that the shipment of the goods is too risky, requires too many resources or is impossible with the available courier / transport providers.
16.5. All Goods offered by Acrista Art, which are published on the Site, with the exception of the goods defined in item 12.5., are delivered at the expense of the Client.
16.6. Original paintings worth over BGN 500 are sent at the expense of Acrista Art, but only on the territory of the Republic of Bulgaria. Acrista Art reserves the right to charge an additional delivery fee for delivery of original paintings outside the Republic of Bulgaria, depending on the chosen destination and method of delivery.
16.7. For the territory of the Republic of Bulgaria, Acrista Art sends the Goods to the client with the courier function "Review" enabled, and the Client has the right to accept or refuse the Goods upon receipt.
17.1. The Seller offers all Goods on the Platform with a guarantee of compliance of the goods with the Contract in accordance with applicable law.
18.1. The ownership of the Goods will be transferred by Acrista Art at the moment of their receipt by the Client, after the payment has been made by the Client. The delivery of the Goods will be certified by the signature of the Buyer on the transport document provided by the courier.
18.2. Unless the parties have agreed otherwise in writing, by purchasing an original painting the Client agrees that Acrista Art reserves the right to duplicate (reproduce, print), physically or digitally, the picture purchased by the Client whenever and in any quantities they may wish, on any media or by any reproduction technology.
19.1. Acrista Art shall not be liable for any damages suffered by the Client as a result of force majeure or circumstances beyond the control of Acrista Art.
Please review the privacy policy described in Chapter 13. Privacy, as well as Chapter 21, Use of Cookies, which describes the data that is processed during your session through cookies.
20.1. Acrista Art uses various software products for statistical processing of traffic data from the Site.
21.1. This Site uses cookies to store data related to your session, including the contents of your Shopping Bag, used filters and settings. By using the Site, you agree to the use of cookies by Acrista Art.
22.1. Neither party will be liable for non-performance of its contractual obligations if such non-performance is due to force majeure. Force majeure is an unforeseeable event, beyond the control of the parties, which cannot be avoided.
22.2. If within 14 (fourteen) days from the date of the force majeure event it does not cease to exist, each party has the right to notify the other party that it terminates the Contract without being liable to the other party for any compensation for any possible damages incurred.
23.1. Bulgarian legislation is the one applicable to this contract. By accepting these general terms and conditions, the Client understands and agrees that any disputes arising between Acrista Art and Clients will be resolved by mutual agreement or if this is not possible, the disputes will be resolved before the competent Bulgarian courts. The sales contracts concluded between the Client and Acrista Art through the Site are ruled by the respective competent Bulgarian court in accordance with the Bulgarian legislation, unless the parties have agreed otherwise.
24.1. The option for purchasing original Acrista Art original artwork on instalments is only available to Bulgarian customers.
